(1)If an extreme risk protection
order or temporary extreme risk protection order is terminated or expires without
renewal, a law enforcement agency holding any firearm that has been surrendered
pursuant to section 13-14.5-108 or taken custody of pursuant to section 16-3-301.5,
or a federally licensed firearms dealer described in 18 U.S.C. sec. 923, as amended,
with custody of a firearm, or a relative with custody of an antique firearm or curio or
relic pursuant to section 13-14.5-108 (1)(a)(III), must return the firearm requested by
a respondent within three days only after confirming, through a criminal history
record check performed pursuant to section 24-33.5-424, that the respondent is
currently eligible to own or possess a firearm under federal and state law and after
