§ 123150. — 123150. (Added by Stats. 1995, Ch. 415, Sec. 8.)

The board of supervisors may authorize the destruction or the disposition to a public or private medical library of any X-ray photographs and case records that are more than five years old and that were taken by the county health officer in the performance of his or her duties with regard to tuberculosis if any of the following conditions are complied with:
(a)
The county health officer has determined that the X-ray photographs or a series of X-ray photographs in conjunction with case records do not show the existence of tuberculosis in the infectious stage.
(b)
The individual of whom the X-ray photographs were taken has been deceased not less than two years or the 102nd anniversary of the individual’s birthdate has occurred and the county health officer cannot reasonably ascertain whether the individual is still living.
(c)
The place of residence of the individual of whom the X-ray photographs were taken has been unknown to the county health officer for 10 years.
