(a)Except as provided in subdivision (b), any person who purposely takes any racing pigeon that at the time of taking is registered with a recognized organization is guilty of a misdemeanor.
(b)This section does not apply to either of the following:
(1)The taking of a registered racing pigeon by its owner.
(2)The incidental take of a registered racing pigeon while shooting or taking a wild band-tailed pigeon or domestic pigeon (Columba livia).
