Art. 1.ARTICLE 1. General Provisions

As used in this chapter:
(a)“State project” means any construction project undertaken by the state, or the state and federal government jointly, which will cause a sudden influx of people into the area affected and where sufficient housing, schools, and other community facilities are not available. For the purposes of this subdivision, the Governor is hereby empowered to proclaim any major construction project undertaken by the state as a “state project” and define the area affected or likely to be affected thereby if both of the following conditions are satisfied:
(1)The Governor finds that the construction project will cause a sudden influx of people into the area.
(2)The Governor is requested to do so by the county board of supervisors.

As used in this chapter:
(a)
“State project” means any construction project undertaken by the state, or the state and federal government jointly, which will cause a sudden influx of people into the area affected and where sufficient housing, schools, and other community facilities are not available. For the purposes of this subdivision, the Governor is hereby empowered to proclaim any major construction project undertaken by the state as a “state project” and define the area affected or likely to be affected thereby if both of the following conditions are satisfied:

The Governor finds that the construction project will cause a sudden influx of people into the area.
(2)
The Governor is requested to do so by the county board of supervisors.
The proclamation shall be in writing and shall take effect immediately. As soon thereafter as possible it shall be filed in the office of the Secretary of State.
(b)
“Board” means the State Allocation Board.
(c)
“Director” means the Director of Education for kindergarten and grades 1 to 12, inclusive.
(d)
“Project” means the purposes for which a school district has applied for an apportionment.
(e)
“Construction project” means the purposes for which a school district has applied for an apportionment at a given location.
(f)
“Grade level maintained by a district” means any of the following:
(1)
The kindergarten, if any, and grades 1 to 6, or grades 1 to 8, inclusive, maintained by an elementary school district or a unified school district.
(2)
Grades 7 to 12, inclusive, grades 9 to 12, inclusive, or grades 7 to 10, inclusive, maintained by a high school district or unified school district, but not more than one grade level shall be claimed by any district under any one of the paragraphs of this subdivision.
(g)
“Apportionment” means an apportionment made under this chapter unless the context otherwise requires.
(h)
“Project children” means children of parents who have come to the district subsequent to the start of the state project and who are employed by the State of California or the federal government in connection with a state project and children of parents employed by any contractor or subcontractor of a state project.
(i)
“Indirect project children” means children of parents who have come to the district subsequent to the start of the state project and who are not employed by a contractor or subcontractor of a state project but who are children in the area in addition to those which would be expected as a result of normal development and growth of the area as determined pursuant to regulations of the director which he or she is hereby authorized to adopt.
(j)
“Parent” includes a legal guardian or other person standing in loco parentis.
(k)
“Department” means the State Department of Education.
