A.If the petition requests the board of supervisors to submit to the electors of the district the question of vesting the proposed district with the power of drainage, the board shall hear all matters relating to the need for drainage of the lands of the proposed district and may by final order duly entered refuse or grant such request of the petitioners.
B.The board shall not exclude from the district lands susceptible of sustaining drainage benefits or lands which, through flowage or seepage either surface or underground from the irrigation thereof or from canals and ditches supplying water thereto, will contribute to the water logging of other lands of the proposed district. The board shall not include lands not susceptible of sustaining drainage benefits and which will not contribut
