(a)(1) If a majority of the qualified electors of the proposed district voting thereon at such election shall vote for the establishment of the district, the district shall be established in the manner provided in this section, §§ 6-61-101 - 6-61-103 , §§ 6-61-201 - 6-61-209 , § 6-61-211 [repealed], §§ 6-61-212 - 6-61-216 , §§ 6-61-301 - 6-61-305 , § 6-61-306 [repealed], § 6-61-401 , § 6-61-402 , §§ 6-61-501 - 6-61-514 , §§ 6-61-516 - 6-61-524 , §§ 6-61-601 - 6-61-603 , and §§ 6-61-604 - 6-61-612 [repealed].
(2)If a majority of the qualified electors of the proposed district voting thereon at the election vote against the establishment of the district, the district shall not be established, and no new election for the establishment thereof shall be held for a period of one (1) year there

(3) However, if the proposed district includes more than one (1) county or city, the majority required for the purposes of this section, §§ 6-61-101 - 6-61-103 , §§ 6-61-201 - 6-61-209 , § 6-61-211 [repealed], §§ 6-61-212 - 6-61-216 , §§ 6-61-301 - 6-61-305 , § 6-61-306 [repealed], § 6-61-401 , § 6-61-402 , §§ 6-61-501 - 6-61-514 , §§ 6-61-516 - 6-61-524 , §§ 6-61-601 - 6-61-603 , and §§ 6-61-604 - 6-61-612 [repealed] shall include not only a majority of the electors of the proposed district voting on the issue at the election but shall also include a majority of the electors voting on the issue in each county or city of the proposed district, or if the proposed district consists of described contiguous territory in one (1) or more counties or cities, the majority required for the purposes of this section, §§ 6-61-101 - 6-61-103 , §§ 6-61-201 - 6-61-209 , § 6-61-211 [repealed], §§ 6-61-212 - 6-61-216 , §§ 6-61-301 - 6-61-305 , § 6-61-306 [repealed], § 6-61-401 , § 6-61-402 , §§ 6-61-501 - 6-61-514 , §§ 6-61-516 - 6-61-524 , §§ 6-61-601 - 6-61-603 , and §§ 6-61-604 - 6-61-612 [repealed] shall include not only a majority of the electors of the proposed district voting on such issue but shall also include a majority of the electors voting on the issue in the portion of any county or city of the proposed described district. (b) The vote in a particular city shall be considered separately only if the boundaries of the city are used to describe the district separate from the boundaries of the county in which the city is located.
