(a)(1) Accurate information about the retention and graduation rates of students at state-supported colleges and universities is needed in order for the Arkansas Higher Education Coordinating Board, institutional boards of trustees, the General Assembly, and institutional faculty members and administrators to make informed decisions related to the coordination, governance, financing, and academic policies of higher education in Arkansas.
(2)Special attention to the retention and graduation rates of students who participate in intercollegiate athletics is needed because the percentage of student athletes who graduate is lower than for students who do not participate in athletics at many institutions throughout the nation.

(b) (1) (A) The Division of Higher Education, in consultation with the colleges and universities, shall recommend a system for the collection of information as to the retention and graduation rates of students at state-supported colleges and universities to the board, the Governor, the House Committee on Education, the Senate Committee on Education, and the colleges and universities. (B) In addition to retention and graduation rates for all students, the report shall also include the retention and graduation rates of all students who participate in intercollegiate athletics. (2) Except as provided in subsection (c) of this section, officials of state colleges and universities shall provide to the division the information requested by the division by December 1 of each year, beginning in 2000. (3) (A) For the purpose of analysis by the Bureau of Legislative Research to guide the General Assembly's evaluation of the need for adjustments to eligibility and funding levels for state-supported student financial assistance, the Office of Accountability shall provide annually to the bureau all individual student demographic and test result data on ACT or ACT-equivalent college placement exams. (B) The office shall provide the data in a database or spreadsheet format that omits personally identifiable information. (c) (1) Subject to an adequate appropriation for the personnel and equipment necessary to implement the system recommended under subdivision (b)(1) of this section, the division shall collect the information described in subdivision (b)(1) of this section and report its findings to the board, the Governor, the House Committee on Education, the Senate Committee on Education, and the colleges and universities by May 1 of each year, beginning in 2000. (2) Notwithstanding the provisions of subdivision (c)(1) of this section, colleges and universities shall commence the collection of information as to the retention and graduation rates of all students who participate in intercollegiate athletics beginning in the fall semester of 1989 and shall report this information to the division by December 1 of each year, beginning in 2000. (d) The board is hereby authorized to promulgate rules consistent with the intent and purpose of this section.
