§ 6-51-202 — Authority to establish schools

(a) The Arkansas Higher Education Coordinating Board is authorized to establish or designate one (1) or more area vocational-technical and adult education schools of less than college grade for the purpose of offering training in the various areas which may be prescribed by the United States Congress for persons sixteen (16) years of age or over. (b) The location of the school or schools shall be determined by the board by formal resolution which shall be made a part of the minutes of the board, and a copy shall be filed with the Secretary of State. (c) (1) In the event more than one (1) school is established, the location of the school or schools shall be in different congressional districts until a school has been established in each congressional district. (2) The board may, without regard to the foregoing limitation, designate any area vocational-technical and adult education school for location on lands owned by any school district which, in its application made and filed with the board, proposes to construct and operate such a school. (3) However, this authority would be applicable only if state funds for construction of area vocational-technical and adult education schools are not available. (4) In the event the board designates an area school to be constructed and operated by a school district, the school district board of directors must provide operating funds from local sources, except that federal funds which are now available or which may hereafter be provided by the United States Government may be used as operating funds.
