Text
For a violation which is subject to the provisions of this chapter, the consumer shall recover from the persons violating this chapter an amount equal to:
(1)Ten percent (10%) of the transaction total or one hundred dollars ($100), whichever is greater; and (2) The actual damages, including any incidental, consequential, and special damages sustained by the consumer as a result of the violation.
