§ 3-9-211 — Permit to sell beverages - Scope - Effect on other laws

(a) Any permit to sell alcoholic beverages for on-premises consumption shall include authority to sell beer for consumption on the same premises, and the provisions of § 3-5-307(7) and (8) shall not apply to premises covered by a permit issued under this subchapter. (b) An on-premises consumption permit shall not authorize the selling or dispensing of alcoholic beverages by the package or bottle. (c) (1) Any permit to sell alcoholic beverages for on-premises consumption shall also include authority to sell native and imported wine by the drink. (2) However, nothing in this subchapter shall repeal subchapter 3 of this chapter regarding the licensing of restaurants to sell wines as authorized in those sections. (3) It is the intent hereof that a permit issued under this subchapter for sale of alcoholic beverages for on-premises consumption shall include authority to sell native or imported wines by the drink on the licensed premises, but any restaurant not wishing to obtain a license under this subchapter may obtain a license under subchapter 3 of this chapter to sell wines as authorized therein. (d) A permit to sell alcoholic beverages for on-premises consumption includes the authority to sell hard cider.
