Text
(a)The Insurance Commissioner shall issue an order approving or disapproving a proposed plan of reorganization within thirty (30) days after the close of the public hearing as required by § 23-69-306 .
(b)The commissioner shall not approve a proposed plan of reorganization unless he or she finds that:
(1)The plan of reorganization is fair and equitable to the policyholders;
(2)The plan of reorganization does not deprive the policyholders of their property rights or due process of law; and (3) The reorganized stock insurer would meet the minimum requirements to be issued a certificate of authority by the commissioner to transact the business of insurance in this state, and the continued operations of the reorganized stock insurer would not be hazardous to future policyholders and the pu
