Text
(a)The Securities Commissioner shall administer this chapter.
(b)The commissioner may:
(1)Make, amend, and rescind any rules, forms, and orders that the commissioner deems necessary or appropriate to carry out this chapter, including without limitation rules and forms governing applications and reports; and (2) Define any terms, whether or not used in this chapter, if consistent with this chapter.
(c)A rule, form, or order shall not be made, amended, or rescinded unless the commissioner finds that the action is:
(1)Necessary or appropriate in the public interest or for the protection of consumers; and (2) Consistent with the purposes fairly intended by the policy and provisions of this chapter.
(d)All rules and forms of the commissioner shall be published.
