§ 23-15-103 — Gas rates

(a)(1) A gas line or company operating in this state that renders a domestic or general service to the public in the furnishing and sale of gas is required to buy or furnish from the lowest or most advantageous market.
(2)Failure to comply with subdivision (a)(1) of this section shall deprive a gas line or company of the difference in price between the market price and the price at which the purchase is made.
(3)In determining the lowest or most advantageous market as described in subdivision (a)(1) of this section, the Arkansas Public Service Commission may take into consideration various factors, including without limitation:
(A)Price;
(B)Methodology of production;
(C)Reliability of supply;
(D)Impact on customer choice; and (E) Conditions associated with transportation or storage.
