Text

(a)In addition to any other penalty prescribed by existing laws, the penalties for violation of this subchapter and the disbursement of fines shall be as follows:
(1)A first violation of this subchapter is a Class A misdemeanor;
(2)A second violation of this subchapter is a Class D felony;
(3)A third or subsequent violation is a Class D felony, and the dealer's license shall be suspended for three (3) years for each respective third or subsequent violation; and (4) In addition to or instead of the penalties listed under subdivisions (a)(1)-
(3)of this section, the Director of the Division of Arkansas State Police may issue a fine in an amount not to exceed one thousand dollars ($1,000) for each violation of this subchapter.
