(a)The Governor shall from time to time select from the membership of the Arkansas Racing Commission a chair and a vice chair.

(b)(1) The Secretary of the Department of Finance and Administration shall be ex officio director of the commission unless the Governor shall designate another person from the Revenue Division of the Department of Finance and Administration to serve in that capacity, but the Director of the Arkansas Racing Commission shall not be a member of the commission nor shall he or she have a vote on matters coming before it.

(2)The Director of the Arkansas Racing Commission shall be the commission's executive officer and shall administer the provisions of this chapter and the rules and orders established under this chapter.

(4) The Director of the Arkansas Racing Commission shall be custodian of all property held in the name of the commission and shall be the ex officio disbursing agent of all funds available for its use. (5) The Director of the Arkansas Racing Commission shall furnish bond to the state, with a corporate surety thereon, in the penal sum of twenty-five thousand dollars ($25,000), conditioned that he or she will faithfully perform his or her duties of office and properly account for all funds received and disbursed by him or her as Director of the Arkansas Racing Commission. (6) Within such limitations as may be provided by appropriations therefor, the Director of the Arkansas Racing Commission may employ such assistants and other personnel as are, in his or her opinion, necessary to properly administer the provisions of this chapter.
