(a)When a death occurring in this state has not been registered within the time period prescribed by § 20-18-601 , a certificate may be filed in accordance with rules promulgated by the State Board of Health. The certificates shall be registered subject to such evidentiary requirements as the board shall by rule prescribe to substantiate the alleged facts of death.
(b)When an applicant does not submit the minimum documentation required by rule for delayed registration or when the State Registrar of Vital Records has cause to question the validity or adequacy of the applicant's sworn statement or the documentary evidence, and if the deficiencies are not corrected, the state registrar shall not register the delayed certificate of death and shall advise the applicant of the reasons for this
