§ 15-43-239 — Responsibilities of guides and their employers, etc

(a) As used in this section, "guide" means any person who shall for pay or for other consideration aid, help, or assist any person or persons in locating, pursuing, chasing, hunting, or killing in this state any game bird, game, fur-bearing animal, or fish protected under the laws of the state, or who shall for hire accompany any person or persons on a hunting expedition or trip. (b) Any person who acts as a guide for another person shall be equally responsible with that person for any violation of the game and fish laws of this state unless the guide shall report to the Arkansas State Game and Fish Commission or its representative any violation of the game and fish laws committed by a person being guided by him or her. (c) Any person employing and accompanying a guide shall be equally responsible with the guide for any violation of the game and fish laws of this state committed by the guide when he or she is in the employ of that person. (d) Any person violating any provision of subsections (b) and (c) of this section shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not less than twenty-five dollars ($25.00). (e) If the operator of a boat dock or fishing landing recommends the employment of a guide by a fisherman, such recommendation shall not cause the relationship of employer and employee to arise between the boat dock or fishing landing operator and the guide.
