Text
(a)(1) Upon the filing of a petition, it shall be the duty of the county clerk to present the petition to the county judge.
(2)(A) The judge shall thereupon set a date and time, not more than sixty (60) days and not less than thirty (30) days after the date of the presentation of the petition to the judge, for a hearing, before the county court, for consideration of the petition.
(B)A notice of the hearing shall be published for two (2) consecutive weeks in a newspaper of general circulation in the county and, if available, on the website of the county or of the Secretary of State.
(b)(1) At the hearing, it shall be the duty of the court to hear the petition and to ascertain whether those signing it constitute all the owners of the real property to be located in the district.
