§ 14-301-405 — Transcripts

(a) Upon the filing of any bond and affidavit for appeal with the city clerk or recorder, as provided in this subchapter, the city clerk or recorder shall immediately prepare a certified transcript of the record in the case. The transcript shall include copies of the original petition, the bond and affidavit for appeal and the ordinance enacted by the city or town council upon the petition closing and vacating the alley. The recorder or clerk shall certify the transcript, affixing to the certificate of the transcript the seal of the city or town council and shall file the transcript with the circuit clerk of the county. The appeal shall stand for trial upon the first day thereafter that the circuit court shall meet in regular or adjourned session. (b) The appeal, upon motion of any of the parties interested therein, shall be advanced and heard ahead of any and all other cases, such matters being of great public interest and importance. Upon notice by any interested party requiring him to do so, the city clerk or recorder shall file with the circuit clerk any or all of the original papers in such matters.
