If any person shall be damaged by the conduct of the recorder, that person may commence an action on his or her official bond in the name of the state to his or her use. Rev. Stat., ch. 124, § 3; C. & M. Dig., § 8619; Pope's Dig., § 11211; A.S.A. 1947, § 12-1003.
