(a)All expenses incurred while on duty or assembled therefor by order of the Governor, upon the request of either the judge, sheriff of a county, or mayor of a city, in aid of the civil authorities, in case of riot, tumult, breach of peace, or resistance to process of this state, or to preserve the public health and safety; all expenses incurred in connection with such duty or as a result thereof, including quartering, caring for, warning for duty, and transporting and subsisting the troops; and all other expenses, including the expense incurred for pay, care, and subsistence of officers and enlisted personnel temporarily disabled in the line of duty, while on such duty, shall be paid by the county or city at the request of whose judge, sheriff, or mayor, as the case may be, the military

(a) All expenses incurred while on duty or assembled therefor by order of the Governor, upon the request of either the judge, sheriff of a county, or mayor of a city, in aid of the civil authorities, in case of riot, tumult, breach of peace, or resistance to process of this state, or to preserve the public health and safety; all expenses incurred in connection with such duty or as a result thereof, including quartering, caring for, warning for duty, and transporting and subsisting the troops; and all other expenses, including the expense incurred for pay, care, and subsistence of officers and enlisted personnel temporarily disabled in the line of duty, while on such duty, shall be paid by the county or city at the request of whose judge, sheriff, or mayor, as the case may be, the military forces of the state have been ordered out. (b) If troops on duty in aid of the civil authorities render service in more than one (1) county or city, the expenses and compensation of the troops shall be apportioned among counties or cities in which the service is rendered by the officer who approves the vouchers and payrolls for such expenses and compensation, certified by the officers commanding the forces, and approved by the Governor. The Governor shall allow the expenses and direct that the claims be paid to the forces ordered to duty out of the general revenue of the county or city, as the case may be. However, where the troops are called out by the Governor to aid in the prevention or suppression of contagious diseases or other causes where the entire state is involved, the expenses shall be paid by the state. (c) Any county treasurer or public officer who neglects or refuses to perform any of the duties required by this section shall be personally charged with the costs and all necessary disbursements of any action or proceeding brought to compel such performance, together with a reasonable additional allowance to the plaintiff or relator in the action or proceeding, to be fixed by the court.
