§ 45-58-261 — Installation of Traffic Control Devices; Liability

Regulations adopted by the Shelby County Planning Commission or regulations adopted pursuant to Section 11–52–31, by a municipal planning commission governing the subdivision of land within Shelby County or any municipality therein may include provisions permitting the owner or developer of a subdivision to install devices for control of access to the subdivision either on public or private roads. The installation of the devices shall not create liability on the part of the municipality, county, or an owner or developer of the subdivision for the installation or maintenance thereof, provided, however, that no owner or developer shall be relieved of liability for the negligent installation or maintenance of a mechanical security device.
