Text

As used in this subpart the following words shall have the following meanings:

(1)ELIGIBLE PERSON. An eligible person shall not be one who is currently charged with, or in the past was convicted of, the offense of murder, robbery in the first or second degree, kidnapping in the first degree, rape in the first degree, sodomy in the first degree, sexual abuse in the first degree or any other forcible sex crime, any lewd and lascivious acts upon a child, arson in the first degree, unlawful distribution of controlled substances or trafficking in controlled substances, assault in the first degree, or who has previously demonstrated a pattern of violent behavior.
