(a)(1) There is created a body to be known as the Shelby County Work Release Commission, hereinafter called the commission.
(2)The commission shall be composed of the following persons:
a.
The Sheriff of Shelby County.
b.
The District Attorney of Shelby County.
c. The Public Defender of Shelby County.
d.
The President of the Shelby County Bar Association.
e.
Four persons to be appointed by the Shelby County Commission.
f.
The Clerk of the Circuit Court of Shelby County.
(3)The terms of the members who are elected officers shall coincide with the terms of their public office and shall expire upon the termination of their elected public office term and shall pass to their successors in office. (3)
The terms of the members who are elected officers shall coincide with the terms of their public office and shall expire upon the termination of their elected public office term and shall pass to their successors in office. For the members who are to be appointed by the county commission, their terms shall be for a period of six years.
(b)
The commission shall implement this subpart and generally superintend all administrative functions pursuant to this subpart, subject to duly adopted rules of court of the circuit and district judges of Shelby County. The commission may not direct any judicial officer in the exercise of his or her judicial functions.
(c)
The commission may:
(1)
Employ and dismiss personnel.
(2)
Direct, regulate, and supervise personnel.
(3)
Obtain fidelity bonds for the faithful performance of the duties of the personnel.
(4)
Create positions and set pay grades necessary for the implementation of this subpart.
(d) The commission may buy, sell, lease, or otherwise hold real or personal property in its own name, and any incidental powers associated therewith that are necessary for accomplishing the purposes of this subpart.
(e) The commission may contract with other persons or entities for the provision of goods and services required by it, on terms and conditions as may be convenient, as allowed by the laws and regulations concerning purchases made by public boards and commissions in the State of Alabama.
(f) Upon the voluntary dissolution of the commission or upon its termination by law or rule of court, all of its assets (other than those assets held for the benefit of some other person or entity) whether real or personal, tangible or intangible, shall become the property of Shelby County.
(g) The commission may issue subpoenas to compel the attendance of witnesses before the commission.
(h) The commission is designated as the agency to apply for, receive, and administer:
(1) Any grant of funds by the United States government or any federal agency, the State of Alabama or any state agency, or Shelby County.
(2) Any grant of funds by any private or quasi-governmental foundation, corporation, firm, or agency which is made available by the entity for the accomplishing of the objectives of this subpart.
(i) The commission shall elect a chair from among its members and other officers as needed. The commission shall make and publish its own rules for the conduct of its affairs. All meetings of the commission shall be held in Shelby County and shall be held at the call of the duly elected chair. The chair shall be required to call a meeting of the commission upon the request in writing of any four of the members of the commission.
(j) The commission may transport eligible persons to any job site within the county and shall not be liable for any damage or injury caused to the eligible person during the transportation.
(k) The commission, its members, agents, and employees shall be exempt from civil liability for any act or omission occurring while acting in an official capacity.
