Text

(a)This subpart shall be enforced by the county commission.
(b)The county commission may commence a civil action in the name of the Shelby County Commission or Shelby County, Alabama, or both, in the Circuit Court of Shelby County, Alabama, to abate or enjoin any public nuisance declared by this subpart. In any action, the Circuit Court of Shelby County, Alabama, shall assess all costs of abating the public nuisance declared by this subpart, including attorney’s fees, court costs, and all other expenses of litigation, against the person creating or maintaining the public nuisance.
