At the time Shelby County becomes subject to this part, all employees and appointees holding full-time positions in the classified service of the county shall be granted permanent status in the classified service and designation as a regular employee as herein defined. All employees employed in a position in the classified service that have not completed their probationary period shall be required to complete it before gaining the designation as regular employees as defined herein. (2)
A classified service comprised of all employees and appointees holding regular full-time permanent positions in the service of the county. Employees occupying these positions shall be deemed to be in the classified service unless specifically exempted from the service in accordance with this part.
(3)
The unclassified service shall include, but not be limited to, the following:
a.
Officials elected by popular vote.
b.
The county attorney, county manager, and county engineer.
c.
Consultants or independent contractors to the commission, or both.
d.
Individuals employed in positions which are funded either partially or fully through federal, state, or local grants.
e.
Guards performing security duties associated with either court-house security or inmate work details.
f.
Employees occupying the positions of project director, secretary, computer operator, or any other positions of the drug task force under the supervision of the Sheriff of Shelby County or an incorporated board.
g.
Part-time members of boards.
h. Attorneys, physicians, surgeons, and dentists who, with permission of the appointing authority of a governing body, engage in outside similar employment.
i. The administrator, chief appraiser, supervisor of collections and assessments, and the supervisor of business personal property for the property tax commissioner; and any employees or appointees paid through the discretionary fund of the property tax commissioner. Not-withstanding any other provisions of this part or any other law to the contrary, the property tax commissioner may from time to time adopt job descriptions and assign duties and responsibilities to the unclassified positions in the office of the property tax commissioner as determined appropriate.
j. Any employees or appointees paid through the discretionary fund of the property tax commissioner who receive or received more than 50 percent of their total compensation from the fund.
k. The administrator of probate and recording services (chief clerk) and the assistant to the judge of probate. Any employees or appointees paid through the Index Fund (a discretionary fund of the judge of probate) or paid through the Mental Health Program Discretionary Fund of the judge of probate established by Act 2013–359, who receive or received more than 50 percent of their total county compensation from one of the funds.
l.
The chief probation officer-juvenile court service director appointed by the district court judge that is designated as the judge of the juvenile court. The county manager may provide performance information to the district court judge concerning the chief probation officer-juvenile court services director.
m. Coroner and deputy coroner and any other employees under the supervision of the coroner.
n. Employees occupying positions recognized as either part-time, temporary, students and interns, and emergency.
(4) All unclassified service positions in the following departments shall be governed by the leave policies and compensation schedule as outlined within this part: County commission, judge of probate, property tax commissioner. Full-time employees in the unclassified service of the county commission, the office of judge of probate, and the office of property tax commissioner shall receive benefits eligibility as with the classified service. No board or appointing authority shall be authorized to designate an individual in the unclassified service as a regular employee in the service of the county.
