(a)Commencing on October 1, 2023, if the Judge of Probate of Pickens County is licensed to practice law in this state and is authorized to exercise equity jurisdiction, the judge of probate shall be entitled to and shall receive an additional expense allowance in an amount of one thousand seven hundred thirty-three dollars ($1,733) per month to be paid from the general fund of the county in the same manner as the salary of the judge of probate is paid. The expense allowance provided by this subsection shall be payable in equal monthly installments and shall be in addition to all other expense allowances, compensation, or salary provided by law. This subsection shall be void on the effective date of subsection (b).

(b)
Effective beginning the next term of the office of the Judge of Probate of Pickens County after August 1, 2023, if the judge of probate is licensed to practice law in this state and is authorized to exercise equity jurisdiction, the Judge of Probate of Pickens County shall receive annual compensation equal to 72 percent of the annual starting initial salary of a circuit judge as set out on August 1, 2023, in Section 12–10B–1(a)(4). This salary shall be in lieu of all other compensation provided by law and shall be paid from the general fund of the county in equal installments in the same manner as other county employees. The salary of the judge of probate under this section shall not increase in amount if the base salary of a circuit judge is increased by law, but the judge of probate shall be eligible for any cost-of-living increases granted to other county officers. When this subsection becomes effective, subsection (a) shall be void.
