Any roads or streets which are located in those areas which have been annexed by the City of Montgomery pursuant to this subpart, which roads and streets were required by this subpart to be maintained by Montgomery County, upon the city and County of Montgomery entering into an agreement for the city to take over from the county the authority to control, manage, supervise, repair, maintain, and improve the roads and streets pursuant to subsection (a) of Section 11-49-80 and Section 11-49-81, as enacted by Act 37, 1921 Extraordinary Session (Acts 1921, p. 50), shall be taken over and maintained by the City of Montgomery conditioned upon the county paying to the city the monetary consideration as set forth in the agreement.
