The owners of property located and contained within an affected area created before May 6, 1988, pursuant to the unanimous petition and election procedures specified in Sections 45-49-140.32 and 45-49-140.33, respectively, may choose to be omitted from that police jurisdiction. If the election procedures of Section 45-49-140.33 are followed, the Judge of Probate of Mobile County shall order an election to be held in the affected area at the request of at least 10 percent of the qualified electors who reside within the boundaries of the affected area.
