§ 45-49-121.01 — Election and Procedures to Determine Whether Utilities Board of Town of Citronelle Subject to Civil Service System

(a) The following definitions apply to this section:
(1) ELECTION. The employees of the utilities board shall vote through secret ballot to determine if the utilities board and its employees shall be subject to the countywide civil service system created by Part 1. The utilities board shall set the date of the election and provide all materials necessary for conducting the election. At least two weeks prior to the election, the utilities board shall post on the main bulletin board of each office of the utilities board the place, date, hours, and purpose of the election. However upon a resolution signed by a majority of the employees of the utilities board, the election shall be held at the time, place, hours, and under the supervision of those set out within the resolution signed by a majority of the employees of the utilities board.
(2) EMPLOYEES. Any full-time employee who has been employed by the utilities board for no less than six continuous months prior to the date of the election and whose normal work week is no less than 40 hours per week or such other period as established by the utilities board as its normal work week.
(3) SYSTEM. The Civil Service System which was created by Part 1, and all subsequent amendments thereto.
(4) UTILITIES BOARD. The Utilities Board of the Town of Citronelle.
(b) The employees of the utilities board shall have the right to determine themselves whether the utilities board shall be subject to the system. If two- thirds or more of the employees of the utilities board voting in the election determine in the election by their vote that the utilities board and its employees shall not be subject to the system, then 30 days after the date of the election, the utilities board and its employees shall no longer be subject to the system and shall not be subject to the system and shall not be subject to the countywide civil service system in any way. Thereafter, the employees shall not be subject to or governed by Part 1 unless a new election has been held which has revoked the decision of the employees as expressed in the preceding election.
(c) The employees of the utilities board shall be governed by the most recent election wherein the employees have decided either to be subject to the system, or to remove themselves from the system. A new election to permit the employees to determine whether the utilities board and its employees shall be subject to the system or shall not be subject to the system shall be held no earlier than two years from the date of the last election.
(d) The provisions of this section are supplemental to other laws not inconsistent with this section and such other laws shall not be deemed to be repealed by this section.
(e) This section applies to conduct occurring after May 29, 1984. Conduct occurring before May 29, 1984, shall be governed by preexisting law.
