Text
(a)This section shall apply to any wastewater system in Marshall County which, as of May 26, 2017, serves one or more developments, is designed and permitted for discharge of wastewater directly to surface waters of the state, is regulated by the Department of Environmental Management, and serves less than 200 customers.
(b)The Public Service Commission shall promulgate and enforce such rules as are necessary to certify and monitor the economic viability of wastewater management systems which are described in subsection (a). Such regulations shall include a requirement that rate charges to customers for wastewater system service shall be approved by the Public Service Commission pursuant to the laws, rules, regulations, and procedures pertaining to utilities.
