(a)(1) In Choctaw County, in addition to any court costs authorized to be collected, there shall be assessed an additional court cost of fifty dollars ($50) in all civil cases filed in the circuit court and district court, except in cases filed in the small claims court the additional court costs shall be twenty-five dollars ($25).

(2)In addition to any court costs authorized to be collected, there shall be assessed an additional court cost of fifty dollars ($50) in all criminal and quasi-criminal cases brought in the circuit court and district court and in any municipal court in Choctaw County.

(3)The court costs provided by this subsection shall not apply to any filings by the district attorney or judge of probate.

(b) All costs assessed pursuant to this section shall be collected by the court clerk as other court costs are collected and distributed to Choctaw County for deposit in a special fund designated as the Jail Fund. All monies paid into the Jail Fund shall be expended by the county exclusively for the payment of the costs of maintaining, repairing, and operating the county jail and jail complex and for paying any indebtedness incurred for the construction of the county jail and jail complex.
