§ 28-8A-10 — No Waiver; Successors and Transferees
Alabama·Title 28 Intoxicating Liquor, Malt Beverages and Wine·Ch. 8A Business Relations Between Wholesalers and Suppliers of Wine
(a)A wholesaler may not waive any of the rights granted in this chapter and the provisions of any agreement which would have such an effect shall be void. Nothing in this chapter shall be construed to limit or prohibit good faith dispute settlements voluntarily entered into by the parties.
(b)This chapter shall apply to agreements in existence on December 31, 2020, as well as agreements entered into or renewed after December 31, 2020.
(c)A transferee of a wholesaler that continues in business as a wholesaler shall have the benefit of and be bound by all terms and conditions of the agreement with the supplier in effect on the date of the transfer; provided, however, a transfer of a wholesaler’s business which requires supplier’s consent or approval but is disapproved by the supplier shal
