(a)There is hereby appropriated from the Education Trust Fund to the Teachers’ Retirement System of Alabama $13,878,629.00 for the fiscal year beginning October 1, 1990. In addition to the appropriation provided herein any available amounts from the existing funds of the Teachers’ Retirement System which may be expended without increasing the unfunded accrued liability of the Teachers’ Retirement System, as determined by the system’s actuary, or any other appropriation to the Teachers’ Retirement System for the fiscal year beginning October 1, 1990, may be allocated and expended by the Secretary-Treasurer to partially fund the benefits provided herein for the fiscal year beginning October 1, 1990. (a) There is hereby appropriated from the Education Trust Fund to the Teachers’ Retirement System of Alabama $13,878,629.00 for the fiscal year beginning October 1, 1990. In the event that funding from the Teachers’ Retirement System is utilized to fund a portion of the benefits provided herein for the fiscal year beginning October 1, 1990 and in the further event that unencumbered funds shall be available in the Education Trust Fund at the end of such fiscal year such amount as shall have been expended from the funds of the Teachers’ Retirement System not included in any appropriations for special pensions to the Teachers’ Retirement System shall be repaid to the Teachers’ Retirement System from such unencumbered funds as soon as possible after the close of said fiscal year.
(b) There is hereby appropriated from the Education Trust Fund to the Employees’ Retirement System $130,753.00 for the fiscal year beginning October 1, 1990, to partially defray the costs of this section as they relate to retired employees of local boards of education and state institutions of higher education who are retired under the Employees’ Retirement System.
(c) The Board of Control of the Teachers’ Retirement System shall determine annually the amount to pay the cost of the benefits provided in this article and shall notify the chief fiscal officer of each employer the percentum rate of earnable compensation of the members required to be paid to the retirement system. Each employer of members of the Teachers’ Retirement System of Alabama shall pay on account of the increase provided in this article in the same manner and from the same source of funds as is provided in Section 16-25-21, it being the intent of the Legislature that the cost of providing the increases provided in this article shall be distributed from all funds in proportion to the salaries paid therefrom for active members.
