ELLIS, Judge.

For the reasons assigned this day in the case of Dixon v. Zemurray, La.App., 82 So.2d 281, it is ordered that the judgment of the District Court be set aside, annulled and reversed and that there now be judgment in favor of the defendant August Dixon and against the plaintiff, Samuel Zemurray dismissing his suit at his cost.
