Opinion

In an action to recover, pursuant to contract, a share of profits of a business which had been diverted by the individual defendant as salary in excess of that agreed upon, and for one month’s salary in lieu of notice of termination of the contract as therein provided, judgment for plaintiff in the sum of $3,298.61, with interest and costs, unanimously affirmed, with costs. No opinion. Present — Hagarty, Johnston, Adel, Taylor and Close, JJ.
