Zebley v. Commercial Travelers Mutual Accident Ass'n of America

245 A.D. 739

Opinion

Action to recover on a policy providing for the payment of $10,000 upon proof of death by accidental means. Judgment reversed on the law and the facts and a new trial granted, costs to abide the event, on the ground that the verdict of the jury is against the weight of the evidence. Lazansky, P. J., Young, Carswell, Tompkins and Johnston, JJ., concur.
