Opinion

Opinion by

Mollison, J.

When the case was called for trial it was submitted without the introduction of any evidence in support of the allegations made in the petition. There being nothing before the court which would warrant the making of the finding required by section 489, supra, as the basis for refund of duties, the petition was denied.
