Opinion
Civilian pay; dismissal; acquittal of criminal charges does not invalidate dismissal. — This case came before the court on defendant’s motion for summary judgment. Upon consideration thereof, together with the response thereto, it was concluded on the basis of the decision by this court in Finn v. United States, 152 Ct. Cl. 1, and cases cited therein, that plaintiff is not entitled to recover, and, on April 13, 1962, the court ordered that the petition be dismissed.
