We have carefully examined the record on appeal and the briefs filed by able counsel. Based thereon we find that the [475]*475learned trial judge did not err. Please see American Baseball Cap, Inc. v. Duzinski, Fla.App. 1st 1975, 308 So.2d 639 in which is cited Zirin v. Charles Pfizer & Co., Fla.1961, 128 So.2d 594 and Gordon v. John Deere Company, Fla.1972, 264 So.2d 419.

Affirmed.
