Order unanimously reversed, with $20 costs and disbursements to the appellant and the motion granted. The prosecution of this action has been unduly delayed and no sufficient explanation for the delay has been shown. Judgment is directed to be entered in favor of the appellant dismissing the complaint herein, with costs. Present — Peck, P. J., Cohn, Callahan, Breitel and Botein, JJ.
