Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.
While an inmate at Auburn Correctional Facility in Cayuga County, petitioner was found in possession of six packets of heroin contained in a law library book bag he was carrying. Following a disciplinary hearing, he was adjudged guilty of [832] possessing a controlled substance. His administrative appeal having been unsuccessful, he commenced this CPLR article 78 proceeding challenging the finding of guilt.
