PER CURIAM.

Order of the special term modified so as to provide as follows: “If the defendant, within 20 days after the due taxation of plaintiff’s costs, and notice thereof, shall pay the same, the motion is denied. If said costs shall not be so paid, the motion is granted.” The order appealed from, as so modified, affirmed, without costs.
