Opinion
Appeal from an order of the Supreme Court, Erie County (John M. Curran, J.), entered June 12, 2006 in a medical malpractice action. The order denied plaintiffs motion to set aside the jury verdict on the issue of negligence.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs. Present—Hurlbutt, J.P., Gorski, Lunn, Fahey and Peradotto, JJ.
