After examining the briefs and appellate record, this panel has determined unanimously that oral argument would not materially assist the determination of this appeal. See Fed. R.App. P. 34(a); 10th Cir. R. 34.1.9. The cause is therefore ordered submitted without oral argument.
The judgment of the district court was predicated upon findings of fact supported by the record. We therefore AFFIRM for the reasons stated by the district court in its order of July 30, 1993. Appellant's motion for leave to file without prepayment of fees is GRANTED.
The mandate shall issue forthwith.
