Opinion

It is ordered and adjudged by this court, that the judgment of the said circuit court be, and the same hereby is, reversed; this court finding that there was sufficient evidence offered by the plaintiffs in the court below to require that the said cause should have been submitted to the jury, and that, therefore, the court erred in sustaining the motion of the defendant to instruct the jury to find a verdict sustaining the will.
