Per Curiam.

The Court of Appeals was in error in reversing, without a bill of exceptions, the judgment of the trial [171]*171court. The judgment of the court is reversed on authority of Smith v. Diamond Milk Products, Inc., 176 Ohio St., 143.

Judgment reversed.
