Civilian pay; dismissal; answer personally. — This case came before the court on plaintiff’s and defendant’s motions for summary judgment. Upon consideration thereof, and on the basis of the decisions by this court in Bryan v. United States, 128 Ct. Cl. 541, and O'Brien v. United States, 151 Ct. Cl. 392, the court, on May 18, 1962, ordered that the petition be dismissed.
