Per Curiam.

The reasons assigned' by Sedgwick, Ch. J., who presided at the trial, justify the order made by him, granting a new trial. Upon an examination of the case, and a consideration of the points submitted on this appeal, we are led to the same conclusion as that reached by the learned trial judge. Order affirmed, with costs and disbursements.
