Appeal from an order of the Supreme Court, Onondaga County (Edward D. Garni, J.), entered July 6, 2004. The order, among other things, denied that part of defendant’s motion seeking dismissal of the complaint in an action for breach of contract.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs for the reasons stated in decision at Supreme Court. Present — Pigott, Jr., PJ., Green, Gorski, Martoche and Hayes, JJ.
